Terms and conditions

I.    General Provisions


1.    These General Terms and Conditions set forth the rules governing the electronic services provided through the website located at “https://pizzahut.franchise. amrest.eu” (hereinafter: “Website”) with respect to end-users visiting the Website (hereinafter: “Users”).
2.    The service is provided by AmRest Franchise Sp. z o.o. (registered office: Poland, 53-332 Wrocław, Powstańców Śląskich Street 15-17; registration number: 0000769844, National Court Register, Business Register; registered by: Commercial Division No. VI of the District Court for Wrocław-Fabryczna; tax identification number: 8982248294.
3.    These General Terms and Conditions contain provisions regarding the provision of services by electronic means pursuant to Section 8 of the Act of July 18, 2002, on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended).
4.    All Users are required to read these General Terms and Conditions and comply with their provisions before beginning to use the Website, as well as to familiarize themselves with the provisions of the Privacy Policy.
5.    The service will be available from December 4, 2025, until further notice.

 

II.    Definitions


1.    Service Provider / AmRest – AmRest Franchise Sp. z o.o. – registered office: Poland, 53-332 Wrocław, Powstańców Śląskich Street 15-17; registration number: 0000769844, National Court Register, Business Register; registered by: Commercial Division No. VI of the District Court for Wrocław-Fabryczna; tax ID: 8982248294.
2.    General Terms and Conditions – these General Terms and Conditions are in accordance with the provisions of Section 8 of the Act of July 18, 2002, on the provision of services by electronic means (Journal of Laws No. 144, item 1204).
3.    Website – the website operated by AmRest through which the User may use the functions described in these General Terms and Conditions.
4.    User – any natural person who visits the Website or uses one or more publicly available services or functions specified in these General Terms and Conditions.
5.    Franchisee (licensee) – a natural person (including the User) or legal entity interested in a franchise partnership with AmRest who contacts us via the form available on the Website.
6.    Service – a service provided electronically by the Service Provider, consisting of providing access to the Website’s content and the contact form, as detailed in Chapter III of the General Terms and Conditions.

III.    Service and Use of the Service


1.    The Service provided consists of the following:
a.    making the Website’s content related to the Service Provider’s activities available to end-users of the Internet;
b.    providing a contact form for inquiries regarding franchise cooperation.
2.    The service is available to Internet end-users.
3.    The service is intended for all Internet end-users who use the Website;
4.    The service is available free of charge.
5.    The service may be used for its intended purpose exclusively on a PC, Mac, or similar computer connected to the Internet and equipped with an operating system (Windows, Mac OS, Linux, or similar) and a web browser (Internet Explorer, Firefox, Chrome, Opera, Safari).
6.    The ability to use the Website’s features is available to all Users without registration or login. All Users may access the Website and browse its publicly available resources.
 

IV.    Liability


1.    The Service Provider shall do everything in its power to ensure that the Service is available every day, continuously, and in full.
2.    The Service Provider shall not be liable for any damages resulting from the improper use of the Service, in particular for damages resulting from the use of the Service by the User or other Users in a manner contrary to the provisions of these General Terms and Conditions.
3.    The Service Provider shall not be liable for any problems arising from the use of the Service if such problems resulted from events that the Service Provider could not have foreseen or could not have prevented with due care, or from unforeseen events of force majeure.
4.    The content on the Website is for informational purposes only and does not constitute legal, business, tax, or investment advice. We have made every effort to ensure the accuracy of the information on the Website; however, the Service Provider does not guarantee its completeness, comprehensiveness, accuracy, or timeliness.
5.    The Website may contain links to content published on other websites. This does not imply that the Service Provider or the authors of the content published on the Website endorse the content on such sites or assume any responsibility for it.

V.    Complaints


1.    Complaints regarding the Service may be submitted via email to the following address: kontakt@amrest.eu.
2.    The complaint must include at least the following: the date and time of the event giving rise to the complaint, the complainant’s email address, and a brief description of the objections raised. Providing this information is voluntary but necessary for the complaint to be processed.
3.    Complaints will be processed within 14 days of receipt, in the order in which they are received.
4.    The person submitting the complaint will be informed via email, at the email address provided in the complaint, regarding how the complaint will be handled.
5.    A User who, prior to entering into the agreement, was clearly and comprehensibly informed of their obligation to cooperate with AmRest to determine, to a reasonable extent and using the least disruptive technical means, whether a breach of the Service Agreement stems from the characteristics of the User’s digital environment, fails to fulfill this obligation.

VI.    Termination of the Contract for the Provision of Services by Electronic Means


1.    The User may terminate any agreement regarding the use of the Website at any time, without cause, and with immediate effect.

VII.    Redirects to Other Services
1.    The Website contains redirects to information and services provided on other websites and through the Application.
2.    The Website also contains redirects to the official social media profile.

 

VIII.    Protection of Personal Data and Privacy Policy


1.    The controller of Users’ personal data is AmRest (registered office: Poland, 53-332 Wrocław, Powstańców Śląskich Street 15-17; registration number: 0000769844, National Court Register, Business Register; registered by: Commercial Division No. VI of the District Court for Wrocław-Fabryczna; tax ID: 8982248294; hereinafter: “Service Provider” or “AmRest”).
2.    The principles of user data protection are set forth in the document titled “Privacy Policy,” which is available on the Website.

IX.    Updates and Modifications to the Website and the General Terms and Conditions


1.    AmRest shall notify Users of any updates, including security updates, that are necessary during the provision of this Service to comply with the agreement regarding access to the Website. During the term of the agreement regarding the provision of the Service, in the event that "AmRest" implements updates that require action on the part of the User, AmRest will notify the User of the update and the possible consequences of its failure via a message displayed on the Website.
2.    AmRest is entitled to modify the method of accessing the Website for important reasons, within the scope and under the conditions permitted by its rights, and in accordance with existing technical capabilities, without impairing the quality of the service or affecting the rights and obligations of Users. The following are considered valid reasons for changes to the manner of service provision:
a.    changes, expansions, or improvements to the Website’s operation;
b.    adapting the Website’s operation to changes in the technical environment.
3.    The Service Provider is entitled to amend these General Terms and Conditions for important reasons, which include the following:
a.    changes in generally applicable laws that directly affect the content of these General Terms and Conditions;
b.    a decision issued by a court or administrative authority that directly affects the content of these General Terms and Conditions; to prevent violations of the law or these General Terms and Conditions;
c.    correction of vague or ambiguous provisions;
d.    the Service Provider’s reorganization (change in corporate form), a change in the Service Provider’s company name, or a change in the registration data, identification numbers, address details, URL, email address, or telephone number specified in these General Terms and Conditions;
e.    Amendments to the General Terms and Conditions shall in no event affect the rights of Users or the obligations of the Service Provider that arose prior to the date on which the amended General Terms and Conditions became binding on Users;
f.    The Service Provider will announce changes to the General Terms and Conditions on the Website and will also notify you by email if you have provided such contact information;
g.    Amendments to the General Terms and Conditions shall take effect with respect to those Users who do not cancel the Services within 14 days of the date of notification of the amendment to the General Terms and Conditions, in accordance with Section 14(3) of the General Terms and Conditions;
h.    The User’s continued use of the Services following the entry into effect of the amendments to the General Terms and Conditions shall constitute acceptance thereof

X.    Information on specific risks associated with the use of services provided electronically

 

The Service Provider hereby informs Users that using services provided electronically, particularly via the Website and the Application, may involve certain risks, such as:
1.    the possibility of receiving spam, i.e., unsolicited advertising, transmitted electronically;
2.    the presence and operation of malicious software, including: computer viruses, i.e., specialized software that, upon execution, is capable of replicating itself and infecting files, generally without the user’s knowledge;
3.    Internet worms (WORM), i.e., the presence and operation of self-replicating malicious programs;
4.    spyware, i.e., the possibility of software that monitors the user’s Internet activity, installed without the user’s knowledge, consent, or control;
5.    hacking or phishing—used to obtain personal and confidential information for the purpose of identity theft by sending false, seemingly authentic electronic messages;
6.    sniffing—unauthorized eavesdropping using a sniffer program designed to intercept and potentially analyze data flowing through the network;
7.    other persons using the information and communication technology system and/or the telecommunications network are given the opportunity to use illegal means that provide unauthorized access to services protected under Directive 98/84/EC;
8.    cryptanalysis activities, i.e., the search for vulnerabilities in a cryptographic system, which could result in the system being cracked or circumvented;
9.    The possibility of exposure to other unwanted or “malicious” software that performs operations not intended by the user, which does not fall under the scope of the above definitions, and appears under the following names: wabbit, Trojan, backdoor, exploit, rootkit, keylogger, dialer, hoax.

XI.    Final Provisions


1.    The obligations arising from these General Terms and Conditions shall be governed by the laws of the Republic of Poland.
2.    AmRest may terminate the provision of the Service granting access to the Website
3.    The court of general jurisdiction in Wrocław shall have jurisdiction over any disputes arising from these General Terms and Conditions between Users and “AmRest” that cannot be resolved amicably.
4.    The Service Provider shall make every effort to comply with the provisions of the Act of April 26, 2024, on ensuring compliance with accessibility requirements for certain products and services provided by economic entities, in order to improve the quality of access to the services offered by the Service Provider
5.    The General Terms and Conditions may be downloaded free of charge in electronic form, in PDF format, from ............................, so that Users may store and view them in the course of their normal activities.
6.    The language of agreements concluded with the Service Provider regarding the services is Polish. The Service Provider also provides access to versions of the General Terms and Conditions in other languages. In the event of any ambiguity regarding the interpretation of the provisions of the General Terms and Conditions, the Polish-language text shall prevail.
